Terms & Conditions

These terms apply to quotations, sales, installation and services by Artha Green Energy Management Solutions ("AGEMS") (GSTIN: 32ASWPL2293A1ZR), and to the use of www.agemsolar.com and design.agemsolar.com. By accepting a proposal (in writing, by signature, or with the "Accept proposal" button in our customer portal) you agree to these terms.

1. Quotations and site survey

• Quotations are valid for 15 days and are based on our site survey, your electricity bills and current component prices.
• Final system size and layout are confirmed after the site survey. If roof conditions differ from what was shared, we will send a revised quotation before any work starts.
• Every quotation lists the brand, model and rating of the main components. We will not substitute a component without your written approval; an approved substitute will be equal or better.

2. Prices and payment

• Prices are in Indian Rupees and include GST at the applicable rate unless stated otherwise.
• Payment schedule: 50% advance on order confirmation, 40% on delivery of materials to site, 10% after installation and commissioning.
• Ownership of the equipment passes to you on full payment.

3. Government subsidy (PM Surya Ghar)

• The central subsidy is available only to eligible residential consumers, and only for systems built with DCR (Domestic Content Requirement, made-in-India cell) solar panels from the government-approved list.
• The subsidy is decided and paid by the Government of India directly into your bank account. AGEMS helps with the application but cannot guarantee approval, the amount or the payment date.
• The subsidy is not a discount from AGEMS. Your agreed price is payable in full regardless of subsidy delays or rejection.

For systems installed under PM Surya Ghar, AGEMS will, as the scheme requires:

• sign the scheme's standard Memorandum of Agreement (MoA) with you before installation;
• provide 5 years of free comprehensive maintenance from commissioning, including repair or replacement of faulty components at our cost;
• give a 5-year warranty on the complete system from the date of commissioning;
• show all prices, taxes and charges clearly, with no hidden costs.

4. KSEB net-metering

• We prepare and submit the net-metering application and coordinate the inspection on your behalf.
• Approval, inspection dates, meter supply and any KSEB fees are controlled by KSEB. Delays on their side do not change the agreed price or payment schedule.

5. Installation

• We agree an installation date with you after receiving the advance and confirming material availability.
• You agree to provide safe access to the roof, an electricity connection for tools, and secure storage for materials on site.
• You confirm that the roof is structurally sound and that you have the right to install the system (for example, approval from the owner, housing society or co-owners).
• Heavy rain, strikes, supply shortages and other events beyond our control may delay work; we will keep you informed.

6. Generation estimates

Generation and savings figures in proposals are estimates based on satellite weather data, your roof and KSEB tariffs at the time. Actual output depends on weather, shading, cleaning, grid availability and tariff changes, and is not guaranteed.

7. Warranties

We help you claim manufacturer warranties. Warranties do not cover damage from misuse, unauthorised changes or repairs, lightning or flood beyond the protection installed, theft, pests, or failure to clean panels as advised.

8. Cancellation and refunds

• Cancellation before we order materials: advance refunded, less the site survey and design charge stated in your quotation.
• Cancellation after materials are ordered: we deduct the cost of materials that cannot be returned and any restocking charges, and refund the balance within 15 working days.
• No cancellation after installation has started.

9. Maintenance

Regular cleaning keeps output high. Free service visits included in your order, and annual maintenance plans, are described in your quotation.

10. Liability

AGEMS's total liability under any order is limited to the amount you paid for that order. We are not liable for indirect losses such as loss of income from power cuts.

11. Website and customer portal

Content on our websites is for general information. Keep your login private; actions taken in the portal using your email login (including accepting a proposal) are treated as yours.

12. Governing law

These terms are governed by the laws of India. Courts in Thiruvananthapuram, Kerala have jurisdiction.
